The rules that govern your use of our website, customer dashboard, and waste collection services. Please read carefully.

1. Acceptance of terms

These Terms of Service ("Terms") form a binding agreement between you and 035 F Arkoh Waste Management ("we", "us", "our"). By creating an account, registering for a service plan, paying an invoice, or otherwise using our website or services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the service.

2. The service

We provide scheduled waste collection services to residential and commercial customers in Ghana, together with a customer dashboard for managing your account, viewing collection history, paying invoices, and submitting complaints. We may add, change, or discontinue features at our discretion.

3. Eligibility & accounts

  • You must be at least 18 years old and capable of entering a binding contract under Ghanaian law.
  • You must provide accurate, current, and complete information when registering — especially your phone number, address, and GPS location, which our drivers rely on to find you.
  • You are responsible for keeping your password confidential and for any activity on your account. Notify us immediately if you suspect unauthorised use.
  • One account per pickup location. Businesses with multiple sites should register each site separately.

4. Plans, pricing & bins

We offer three standard plans — Basic, Standard, and Premium — each with a defined bin size and collection frequency. The current price for each plan is published on our website and applies to invoices generated after the price is set. Prices are quoted in Ghana Cedis (GHS) and are inclusive of any applicable taxes unless stated otherwise.

Bins remain the property of 035 F Arkoh Waste Management unless explicitly sold. You agree to keep your bin in a reasonable state, accessible at the pickup point on collection days, and to report any damage or loss promptly.

5. Collection schedule

  • Pickups are scheduled on your assigned collection day. You will receive an SMS reminder before each pickup.
  • You agree to place your bin at the agreed pickup point before the start of the collection day, and to remove it after collection.
  • Collection times can vary within the day depending on route, traffic, and weather conditions.
  • We may temporarily adjust schedules to account for public holidays, severe weather, or operational emergencies. We'll communicate changes via SMS where reasonably possible.

6. Missed pickups

A pickup may be marked as missed if:

  • The bin was not at the pickup point at the time of arrival;
  • Access to your property was blocked (locked gate, parked vehicles, etc.);
  • There was no one available where customer presence is required;
  • An unforeseen operational issue (road closure, breakdown) prevented the pickup.

You will be notified via SMS when a pickup is marked missed, with the reason. Where the missed pickup was caused by us, we will reschedule at no extra cost. Where it was caused by access issues at your end, you may request a rescheduled pickup, which may be subject to an additional callout fee at our discretion.

7. Billing & payment

  • Invoices are generated monthly. The amount on each invoice is your plan's monthly fee, plus any applicable surcharges (e.g. agreed callout fees).
  • The due date for each invoice is shown on the invoice itself — typically the 25th of the month unless we communicate otherwise.
  • Payment is processed via Paystack. Accepted channels include debit/credit card, mobile money (MTN, Vodafone, AirtelTigo), and bank transfer.
  • A receipt is sent via SMS once payment is confirmed.
  • You are responsible for any bank or mobile-money charges your provider applies to the transaction.
  • Refunds for duplicate payments are processed within 7 business days of confirmation. Refunds for missed services are issued as account credit unless we agree otherwise.

8. Late payment & suspension

If an invoice is not paid by its due date:

  • The invoice is marked overdue and you will receive automated SMS reminders;
  • We may add a late fee, where lawful, to subsequent invoices;
  • If the invoice remains unpaid for more than 30 days, we may suspend pickups until the balance is cleared;
  • Persistent non-payment may result in termination of service and referral to a collections process.

9. Prohibited waste

For the safety of our crew and the integrity of disposal sites, the following items must not be placed in your bin:

  • Hazardous chemicals, paints, solvents, pesticides, or used oils;
  • Medical or clinical waste (sharps, used dressings, expired pharmaceuticals);
  • Asbestos, construction debris, large quantities of rubble or soil;
  • Batteries, fluorescent tubes, and electronic waste (e-waste);
  • Flammable, explosive, or radioactive materials;
  • Liquid waste (e.g. cooking oil in open containers), free-flowing food slurry;
  • Dead animals or animal carcasses;
  • Bin contents exceeding the lid-closeable line of your bin.

If prohibited waste is found, we may refuse the pickup, charge a special handling fee, or — in severe or repeated cases — terminate the account. Customers requiring special disposal should contact us to arrange a dedicated pickup.

10. User conduct

You agree not to:

  • Use the service for any unlawful purpose or to dispose of waste on someone else's behalf without their consent;
  • Tamper with, deface, or remove anyone else's bin or registration markings;
  • Harass, threaten, or assault our drivers or staff;
  • Attempt to bypass authentication, payment, or rate-limiting on our website;
  • Reverse engineer, scrape, or replicate the service for commercial purposes;
  • Submit false complaints or fraudulent payment information.

11. Liability & warranties

We will provide the service with reasonable care and skill. However:

  • The service is provided "as is" without warranties beyond those required by law.
  • We are not liable for indirect, incidental, or consequential losses, including lost profits or reputational damage, arising from missed pickups, schedule changes, or service interruptions.
  • Our total aggregate liability for any claim relating to the service is limited to the fees you paid us in the 3 months preceding the event giving rise to the claim.
  • Nothing in these Terms limits any liability that cannot be limited under applicable Ghanaian law (for example, liability for gross negligence or wilful misconduct).

12. Termination

  • By you — you may close your account at any time by contacting us. Outstanding invoices remain payable.
  • By us — we may suspend or terminate your account if you breach these Terms, fail to pay, place prohibited waste in your bin repeatedly, or behave abusively toward our staff. We will use reasonable efforts to notify you before termination, except where immediate action is required.
  • On termination, we will collect any bin we provided. Sections that are intended to survive termination (e.g. billing, liability, governing law) will continue to apply.

13. Changes to the terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. For material changes (e.g. pricing, payment, or liability), we will notify active customers via SMS or email at least 14 days before the change takes effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the Republic of Ghana. Any dispute arising out of or in connection with the service shall be subject to the exclusive jurisdiction of the courts of Ghana.
